The Idea of environment has never been in the mind of founding fathers of the Indian Constitutions. In the 1980s, the Indian Legal system, underwent a sea change in terms of discarding its moribund approach and, instead, charting out new horizons of social justice. This period was characterized by administrative, legislative and judicial activism. Consequently, the expression ‘Environment’ is does not find mentioned in Indian Constitution. However, there are many items in legislative list, which enables the centre and the state to make law in field of environment.
